Aboriginal elder banished after stabbing

Extract from Australian Broadcasting Corporation - ABC Online, on 25 March 2004

The South Australian Supreme Court has banished a respected Aboriginal leader from his traditional lands for one year.

In June last year, Harry Tjutjuna killed a man by stabbing him in the leg during a fight about a relative's funeral arrangements.

In sentencing, Justice Margaret Nylan said that Mr Tjutjuna was immediately remorseful and tried to help his victim by using his skills as a traditional healer.

She said given that he was at least 80 years old, it would be too harsh to banish Mr Tjutjuna forever and instead ordered him to stay away for one year.

She said that time could be shortened if his community invited him back.
